1. Agreement to Terms
These Terms & Conditions govern your access to and use of Cloud CYDN, a cloud-based CRM, sales, inventory and point-of-sale platform operated by S. Tinis Cydigitalnet Advertising Ltd ("we", "us", "our"). By creating an account or otherwise using the service, you agree to be bound by these terms. If you are entering into this agreement on behalf of a company, you represent that you have authority to bind that company.
2. The Service
Cloud CYDN is provided on a subscription basis. Each subscriber ("tenant") operates within their own isolated workspace and data store. We may add, change or remove features from time to time; we will give reasonable notice of any change that materially reduces the functionality you rely on.
3. Accounts and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorised use. We reserve the right to suspend accounts showing evidence of compromise while we investigate.
4. Subscriptions, Trials and Billing
Paid plans are billed in advance on a recurring basis (monthly or annual, as selected). Free trials, where offered, convert to a paid subscription only if you choose to continue after the trial period; we will not charge you automatically without your consent. Fees are stated exclusive of VAT unless noted otherwise, and VAT is added where applicable under Cyprus/EU law.
5. Your Data
You retain all ownership rights to the business data you store in the service (customers, invoices, products, sales records, and similar). We act as a data processor for that data and will only access it to provide support, maintain the service, or as required by law. You are responsible for the accuracy and legality of the data you input.
6. Acceptable Use
You agree not to use the service to store or transmit unlawful content, attempt to gain unauthorised access to other tenants' data or our infrastructure, or interfere with the service's normal operation. We may suspend or terminate accounts that breach this section.
7. Service Availability
We aim to keep the service available at all times but do not guarantee uninterrupted access. Planned maintenance will, where possible, be scheduled outside normal business hours and notified in advance.
8. Limitation of Liability
To the maximum extent permitted by law, S. Tinis Cydigitalnet Advertising Ltd shall not be liable for indirect, incidental or consequential damages arising from your use of the service. Our total liability for any claim relating to the service is limited to the fees you paid us in the twelve months preceding the claim.
9. Termination
You may cancel your subscription at any time from your account settings; cancellation takes effect at the end of the current billing period. We may suspend or terminate your account for breach of these terms, non-payment, or as required by law. Upon termination, you may request an export of your data within a reasonable period before it is deleted.
10. Changes to These Terms
We may update these terms from time to time. Material changes will be notified by email or an in-app notice at least 14 days before they take effect.
11. Governing Law
These terms are governed by the laws of the Republic of Cyprus, without regard to conflict-of-law principles.
